Implementation of dispute policy likely for .nz domain name
The introduction of a disputes resolution policy for the .nz domain space has taken a step closer. A Working Group of InternetNZ has recommended that a dispute resolution policy be developed and implemented based on the Nominet UK model. Their recommendations included:
(a) The use of an informal mediation step at no charge. UK experience has shown that 64% of cases are resolved at this point;
(b) That disputes be determined by an expert drawn from a pool with a further right of appeal to a three expert appeal tribunal (this being on a full cost recovery basis). Indicative levels of fees suggested by the Working Group were NZ$1,500 - NZ$2,000 for an expert determination and NZ$7,500 for the three expert appeal.
These recommendations are now the subject of public notification before receiving final approval and implementation by the .nz Oversight Committee. It appears likely that the dispute resolution policy will be introduced in the next eight months or so.
